Terms and Conditions for Waste Collection Streatham
These Terms and Conditions set out the basis on which we provide waste collection services in Streatham and the surrounding areas. By booking or using our services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order for waste collection.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means the waste collection, removal, loading, transportation and related services provided by us at your property or other agreed location.
Customer means the person, business, company or organisation booking or receiving the Service.
Waste means any materials, rubbish, junk or items requested to be removed as part of the Service, excluding items that we are not permitted or able to handle under law or these Terms and Conditions.
Booking means a confirmed request for the Service made by the Customer via phone, email, online form or any other method accepted by us.
Contract means the agreement between you and us for the provision of the Service, comprising these Terms and Conditions and the details confirmed in your Booking.
2. Scope of Service
We provide waste collection services to domestic and commercial customers in Streatham and nearby areas. The Service typically includes loading your waste onto our vehicle, transporting it to a licensed facility and arranging lawful disposal or recycling where possible.
We reserve the right to refuse collection of certain items, including but not limited to hazardous waste, clinical or medical waste, asbestos, chemicals, pressurised containers, flammable substances, or any items that we are not licensed or insured to handle. If you are uncertain whether your waste can be collected, you must clarify this with us before making a Booking.
3. Booking Process
You may request a Booking by contacting us through our published telephone number, email address or online booking form. At the time of booking, we may ask for details including your name, contact information, collection address, type and approximate volume or weight of waste, access information, and preferred collection time.
Your Booking is accepted and a Contract is formed when we confirm the details of the Service and the price, either verbally or in writing. We may provide an estimated arrival window for the collection; this is not guaranteed and may be subject to traffic and operational conditions. We will use reasonable efforts to arrive within the agreed window and to keep you updated of any significant delays.
You are responsible for providing accurate and complete information about the waste and the location. If on arrival the waste is significantly different in volume, type, or weight from that described at the time of booking, or if access is more difficult than described, we may adjust the price, modify the scope of the Service, or decline to proceed with the collection.
4. Access and Customer Responsibilities
You must ensure that we have safe, unobstructed and reasonable access to the collection point at the agreed time. This includes ensuring that gates, doors and pathways are unlocked and clear, that any parking or loading restrictions are addressed, and that necessary permissions are in place for our vehicle to stop and load.
If access is not available or is unsafe in our reasonable opinion, we may refuse to carry out the Service. In such circumstances, you may be liable for a call-out fee or cancellation charge as set out in these Terms and Conditions.
You must ensure that the waste presented for collection does not include prohibited or hazardous items and that any sharp or dangerous objects are suitably packaged or identified to minimise risk of injury to our staff.
5. Pricing and Quotes
Prices for our waste collection services may be based on one or more of the following: estimated or actual volume of waste, weight, time on site, type of waste, access conditions, and any additional services requested such as heavy lifting, dismantling, or multiple trips.
Any quotes provided before the collection are based on the information you supply and are subject to inspection of the waste on arrival. Should the actual waste or access conditions differ from those described, we may revise the price before proceeding with the Service. If you do not accept the revised price, you may cancel the Service, subject to any applicable call-out or cancellation charges.
6. Payments
Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due immediately upon completion of the Service. We may accept payment by cash, card or bank transfer, subject to our current payment options.
For commercial customers, we may agree alternative payment terms, such as invoicing with a specified payment period. Any such arrangements must be confirmed by us in writing. Where payment is made by invoice, you agree to pay all sums due by the stated due date. Late payment may result in interest and charges being applied in accordance with applicable UK legislation.
We reserve the right to withhold or suspend the Service if payment is not made in accordance with agreed terms or if we reasonably believe that payment will not be made.
7. Cancellations and Amendments
You may cancel or amend your Booking by contacting us within our normal business hours. We request as much notice as reasonably possible so that we can manage our schedule effectively.
Where you cancel more than 24 hours before the agreed collection time, we will usually not charge a cancellation fee. Where you cancel with less than 24 hours notice, or where we attend the property but cannot complete the Service due to reasons within your control, we reserve the right to charge a reasonable cancellation or call-out fee to cover our costs.
If we need to cancel or reschedule your Booking due to operational reasons, such as vehicle breakdown, staff illness, or safety concerns, we will notify you as soon as reasonably practicable and offer an alternative collection time. We will not be liable for any consequential loss or inconvenience arising from such cancellation or rescheduling, but any deposit or prepayment for the affected Service will be applied to the rearranged collection or refunded if no alternative can be agreed.
8. Waste Handling and Environmental Compliance
We operate in accordance with applicable UK waste management and environmental regulations. We will use licensed waste transfer, recycling and disposal facilities and will handle waste in a manner that complies with relevant legislation and duty of care obligations.
Where required, a waste transfer note or similar documentation may be completed for the collection. You agree to provide any information reasonably required for completion of such documentation, including the nature and origin of the waste.
We aim to minimise the amount of waste sent to landfill by prioritising reuse and recycling where practicable. However, we do not guarantee that any particular item will be recycled or reused, and methods of disposal may vary depending on the nature of the waste and available facilities.
9. Prohibited and Hazardous Waste
Certain types of waste cannot be collected under our standard Service, including but not limited to: asbestos, chemicals, oils, fuel, solvents, clinical waste, sharps, gas bottles, explosives, corrosive substances, radioactive materials, or any other items for which we are not licensed or insured.
If prohibited or hazardous waste is discovered among the items presented for collection, we may refuse to collect those items, adjust the price, or cancel the Service. If such materials present a health or safety risk, we may leave the site immediately. You may be responsible for any additional costs incurred as a result, including safe handling or containment measures.
You agree not to conceal prohibited or hazardous items within general waste. If we incur fines, penalties, clean-up costs or liabilities because you provided such materials without disclosure, you agree to reimburse us for all reasonable costs and expenses arising from this breach.
10. Customer Property and Site Condition
We will take reasonable care when performing the Service at your property. However, the removal of bulky items and the manoeuvring of waste through tight spaces can carry a risk of minor damage. You should take steps to protect floors, walls, fixtures and fittings, and move any valuable or fragile items out of the way before our arrival.
We are not responsible for pre-existing damage or defects, or for wear and tear made apparent by the removal of items. Any damage that does occur must be reported to us in writing within 48 hours of the Service. We may request photos or further information in order to assess the circumstances.
You are responsible for ensuring that any items you ask us to remove are not required by you or any third party. Once items are loaded onto our vehicle, they will be treated as waste and cannot usually be retrieved.
11. Liability and Limitations
Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under UK law.
Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the Service or the Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total amount paid or payable by you for the specific Service giving rise to the claim.
We are not liable for any indirect or consequential loss, including loss of profit, revenue, business, data, or any loss arising from delay, missed appointments, or failure to provide the Service where this results from circumstances beyond our reasonable control, such as severe weather, traffic disruption, accidents, or industrial action.
You are responsible for complying with your own legal obligations in relation to waste on your property. We do not accept liability for any penalties, enforcement action or legal consequences arising from your failure to meet such obligations, except where caused directly by our proven breach of duty.
12. Insurance
We maintain appropriate public liability and, where applicable, employers liability insurance in connection with the provision of our waste collection services. Details of our insurance cover can be made available on request.
Our insurance is subject to standard exclusions and limits. You are advised to maintain your own insurance for your property and belongings, including any buildings or contents insurance that may cover accidental damage or loss.
13. Data Protection and Privacy
We collect and process personal information necessary to manage your Booking and provide the Service, including your name, contact details, address, and information about your waste collection requirements.
We will use your personal information in accordance with applicable UK data protection laws. This may include using your details to confirm bookings, issue invoices or receipts, handle queries or complaints, and comply with legal obligations such as record keeping for waste transfers.
We will not sell your personal data to third parties. We may share information with trusted partners or service providers where necessary to deliver the Service or comply with legal requirements, such as waste disposal facilities or regulatory bodies.
14. Complaints and Dispute Resolution
If you are dissatisfied with any aspect of our waste collection service, you should contact us as soon as possible with details of your concern. We will investigate and respond within a reasonable time, and where appropriate, may offer a remedy such as re-attendance, partial refund or other practical resolution.
We aim to resolve disputes amicably. If a dispute cannot be resolved directly, either party may consider using alternative dispute resolution procedures or seeking legal advice. Nothing in this section limits your legal rights as a consumer in the UK.
15. Changes to These Terms and Conditions
We may update or revise these Terms and Conditions from time to time. Any changes will take effect from the date they are published or notified. The Terms and Conditions in force at the time of your Booking will apply to that particular Service, unless a change is required by law or regulatory authority, in which case the updated terms may apply immediately.
You are advised to review these Terms and Conditions periodically to stay informed of any updates that may affect your future bookings.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service, whether contractual or non-contractual.
17. General Provisions
If any provision of these Terms and Conditions is found to be invalid or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.
Any failure or delay by us to exercise any right or remedy under these Terms and Conditions shall not constitute a waiver of that or any other right or remedy.
You may not assign or transfer your rights or obligations under the Contract without our prior written consent. We may assign or subcontract our rights and obligations where reasonably necessary to provide the Service, provided that this does not materially reduce your rights under the Contract.
These Terms and Conditions, together with the details confirmed in your Booking, constitute the entire agreement between you and us relating to the Service and supersede any prior discussions, understandings or representations, whether written or oral.
